# 4 Elaboration and Drafting of the Project
It is a stage where all the legal documentation required to obtain the necessary permits, visas, and licenses required by the Municipal Regulations is prepared.
If you choose to access a design online or through a call for competition, you must develop the Drafting and Drafting stage of the Project with an authorized local professional, usually an architect.
In the Elaboration and Drafting stage of the Project we can distinguish 2 sub-stages:

You have to think very well about the working modality for the construction stage. You must be strategic and choose very well the technicians and the construction company with which you are going to work.

If you have time and will, you can participate directly in the construction and avoid some costs associated with certain tasks that you can do yourself.
But if you do not have time the best thing will be to delegate the work of incompetent technicians and companies.
Now, let’s see the 2 possible ways to have worked before reaching this stage:
- You started working with an architect from the beginning.
He worked on the design of your house.
He prepared the “Basic and Execution Project” and you have already obtained the necessary permits to start the construction.
Probably the architect (or someone from your team) will be the “construction manager” and together they have selected the construction company to carry out the works.

To elaborate on the “Basic and Execution Project” you could have chosen between two options:

The construction companies have, in general, a team of professionals and technicians from different areas, who can support you from stage 4 and even finish the construction of your house.
If you choose to hire a construction company, your construction manager will be a professional in the company.
The disadvantage of this option is that, in case of any problem or difference with the company, the project manager will always defend the interests of the company over yours.
I advise you that the director of works is someone you trust and independent of the construction company.
What you need is someone who is on your side and who takes care of your interests before any problem with the construction company.
Define the type of contract with the construction company.
This is where the big part of your home budget goes.
Fundamentally in 2 items: the cost of materials and labor for the execution of the works.
It is always advisable to make a contract at “closed price”, that is, you pay for a certain service that must be stipulated and detailed in the contract.
The payments, in general, are made once the progress of the work that has been agreed upon has been made.
You will have 2 options in relation to the costs of the materials:
- The construction company takes care of everything: materials and labor.
- Most companies prefer to work in this way. They have control over everything and work with the prices they get with their suppliers.
- Your earnings are much higher compared to the option to only charge for labor.
- You buy the materials and the construction company only charges for labor.
- Not all construction companies are willing to work with this modality.
- You should contact small companies that are just starting or cooperatives open to this type of work.
- You will be able to save money by having absolute control of the costs of the materials.
If you have no experience in construction and you choose this option, yes or yes you should have a construction manager who is by your side and supports you in this task as well.

Final Work Certificate
In order to complete the construction of the work, the responsible professionals sign a document stating that the work has been carried out according to the Execution Project and they are legally responsible for it.
At this point, the last payments are usually made to the construction company as well as to the competent authority for tax concepts and certifications.
The act of Reception of Works
Document in which the construction company officially delivers the finished work to the owner and is accepted by it. The competent authority is also part of this Act.
This act can be rejected by the owner if it considers that the works are not finished according to the agreement. In this case, the term must be extended, with all the parties involved agree.
This book has been prepared by the works director and is where all the modifications, repairs and contingencies that arose in the construction of the work have been recorded.

New Construction Declaration
A document that, in general, must be written by a notary where it is declared what has been built.
Registration in the Cadastral System.
The new work must be registered in the corresponding Cadastral System.
